The paper analyses problems of formal penalisation and factical depenalisation of crimes in the sphere of economics. The author criticizes the standards of law usage in combating economic crimes, presents her ways of changing this problematic situation. The main attention is paid to the court as the main subject matter of criminal policy which creates standards of law usage in the sphere of economics. Basing on the data of statistics and examples of jurisprudence the author concludes about inefficiency of law mechanism.
