Introduction: the paper deals with the actual problem of the criminal procedural and criminal Executive detention of a person. The generated output norms on the detention of convicted persons, evading from execution of the sentence, it is necessary to register in a separate article and include it in Chapter 47 «the procedure for consideration and resolution of issues related to the execution of the sentence» section 14 «the sentence» code of criminal procedure. Materials and Methods: legal logic methods, rather legal analysis, investigative and case law analysis. Results: the author concludes that it is necessary to include as a separate Article, regulating rules of arrest of the convicted eluding execution of sentence part 14 “Execution of sentence” of the Russian Federation Code of Criminal Procedure into Article 47 “Proceedings for consideration and settlement of questions connected with “Execution of sentence”.
