Введение: в статье раскрываются вопросы, связанные с проблемами обеспечения охраны труда в угольной промышленности, а также безопасности профильного производства, профилактики нарушений, преступлений уполномоченных к охране труда и обеспечению безопасности на производстве В статье демонстрируется анализ содержания национальной уголовной политики в данной сфере. Результаты исследования: в процессе проведения исследования проанализированы актуальные аспекты профилактики преступлений в сфере охраны труда в угольной промышленности с обоснованием основных направлений реализации криминологического знания в практическую деятельность субъектов профилактики преступлений в сфере охраны труда в угольной промышленности Российской Федерации. В соответствии с вышеизложенным на современном этапе профилактика преступности в российской угольной отрасли промышленности реализуется системой субъектов, к основным из которых относятся: органы прокуратуры по надзору за исполнением законов в угледобывающей отрасли; ОВД России; Следственный комитет России; Ростехнадзор; Управление по надзору в угольной промышленности действующее в составе Федеральной службы по экологическому, технологическому и атомному надзору; руководители предприятий; работники, от которых требуется соблюдение требований в сфере охраны труда, обеспечения безопасности профессиональной деятельности; коллективные образования угольной отрасли (профессиональные союзы и др.). Обсуждение и заключение: авторы отмечают основные направления национальной уголовной политики в данной сфере. Определены концептуальные положения, направленные на совершенствование национальной системы профилактики преступности рассматриваемого вида. Научная новизна исследования обусловлена анализом национальных статистических сведений о состоянии, динамике исследуемых деяний, предоставляемых Генеральной прокуратурой России. Данный факт свидетельствует, что информация о данных преступлениях отсутствует, как и в целом по категории посягательств, нарушающих требования охраны труда и правила специальной безопасности.
Introduction: this study reveals issues related to the problems of ensuring occupational safety in the coal industry, as well as the safety of specialized production, the prevention of violations, crimes committed by persons authorized to occupational safety and safety at work who contribute to injuries and victims, as this problem has been of concern to Russia and the entire world community throughout the history of development industries. The article demonstrates an analysis of the content of the national criminal policy in this area. Results: in the course of the study, the current aspects of the prevention of crimes in the field of labor protection in the coal industry were analyzed with the justification of the main directions of the implementation of criminological knowledge in the practical activities of subjects of the prevention of crimes in the field of labor protection in the coal industry of the Russian Federation. In accordance with the above, at the present stage, crime prevention in the Russian coal industry is implemented by a system of entities, the main of which include: the Prosecutor's Office for supervision of the enforcement of laws in the coal mining industry; the Ministry of Internal Affairs of Russia; the Investigative Committee of the Russian Federation; Rostechnadzor; the Office for Supervision of the Coal Industry operating as part of the Federal Service for Environmental, Technological nuclear supervision; heads of enterprises; employees who are required to comply with requirements in the field of occupational safety and security of professional activity; collective formations of the coal industry (trade unions, etc.). Discussion and Conclusions: the authors note the main directions of the national criminal policy in this area. The conceptual provisions aimed at improving the national crime prevention system of this type are defined. The scientific novelty of the study is due to the analysis of national statistical information on the status and dynamics of the acts under investigation provided by the Prosecutor General's Office of Russia. This fact indicates that there is no information about these crimes, as well as in general, in the category of attacks that violate labor protection requirements and special safety rules.
