Введение: в статье рассматриваются подходы к типологизации и определению преступлений, связанных с незаконным оборотом алкогольной продукции. Материалы и методы: в работе использовались логический, системно-структурный и статистический методы. Материалами исследования послужили нормы уголовного законодательства Российской Федерации и зарубежных стран, положения постановлений Пленума Верховного Суда Российской Федерации, научная литература. Результаты исследования: в статье сформулировано понятие преступлений в области незаконного оборота алкогольной продукции. Обсуждение и заключение: обосновывается необходимость систематизации норм уголовного законодательства, предлагается сочетание отраслевого критерия и объективных признаков данных преступлений при их типологизации.
Introduction: the author discusses approaches to typologization and definition of crimes related to illicit trafficking in alcoholic beverages. Violation of the rule of law in this area of economic relations is accompanied by various legal sanctions designed not only to suppress illegal activities, but also to prevent the occurrence of larger negative consequences, including life and health of citizens. However, the complication of criminal legislation in terms of expanding the corpus delicti accompanying the illegal turnover of alcoholic beverages has exposed the need for scientific rethinking of the concept of such acts and their classification taking into account criminal law innovations. Materials and Methods: logical, system and structural, statistical methods were used in the work. The materials of the study were the norms of the criminal legislation of the Russian Federation and foreign countries, the provisions of the decisions of the Plenum of the Supreme Court of the Russian Federation, scientific literature. Results: the concept of crimes in illicit trafficking in alcoholic products is formulated in the article. Discussion and Conclusions: the necessity of systematization of the norms of criminal legislation is substantiated, a combination of the industry criterion and objective signs of these crimes in their typology is proposed.
