Введение: в статье рассматриваются международно-правовые аспекты безопасности дорожного движения (БДД). На основе анализа правовых норм России и зарубежных государств авторами сделан вывод о том, что усиление ответственности за грубые нарушения правил дорожного движения (далее - ПДД) является действенной мерой стабилизации дорожной обстановки. Материалы и методы: материалами исследования явились действующие нормативные акты Российской Федерации, официальные публикации и аналитические обзоры Научного центра безопасности дорожного движения МВД России. Кроме того, были использованы научные труды, авторами которых являются как российские, так и зарубежные ученые. Теоретическую основу исследования составляет диалектический метод познания. В рамках частнонаучных подходов были задействованы статистический анализ, сравнительно-правовой метод и формально-логический анализ. Результаты исследования: в данной работе освещаются проблемы, связанные с законодательным регулированием в области обеспечения безопасности дорожного движения. Проведенный анализ текущей обстановки с дорожно-транспортными происшествиями в России позволил сделать вывод о целесообразности заимствования международного опыта в этой сфере для последующего внедрения в российскую правовую систему. Авторы пришли к заключению, что актуальные научные работы, как отечественные, так и зарубежные, в настоящее время акцентируют внимание не столько на содержании нормативных актов, сколько на эффективности их исполнения и фактическом применении на практике. Обсуждение и заключение: в представленной работе доказывается тезис о необходимости совершенствования правовых инструментов под пристальным контролем законодательных органов.
Introduction: this article examines the international legal aspects of road traffic safety. The article aims to fill a gap in Russian criminal law and propose solutions to key problems in this area. Based on an analysis of the legal systems of Russia and foreign countries, the author concludes that strengthening liability for gross violations of traffic regulations is an effective measure for stabilizing the road traffic situation. Materials and Methods: the research materials were collected from various sources. These include current regulatory acts of the Russian Federation, as well as official publications and analytical reviews from the National Center for Road Traffic Safety of the Ministry of Internal Affairs of Russia, covering the period of 2023-2024. Additionally, scholarly works in the form of monographs and articles by both Russian and foreign academics were used. The theoretical foundation of the research is the dialectical method of cognition as applied to road traffic safety issues. Specific scientific approaches employed include statistical analysis, the comparative legal method, and formal logical analysis. Results: this work highlights the complexities associated with the legislative regulation of road traffic safety. The analysis of the current situation with road traffic accidents in Russia led to the conclusion that it is advisable to borrow international experience in this sphere for subsequent implementation into the Russian legal system. The researchers concluded that current academic works, both domestic and foreign, now focus not so much on the content of regulatory acts as on the effectiveness of their enforcement and practical application. Discussion and Conclusions: the presented work substantiates the thesis that legal instruments must be improved under the close supervision of legislative bodies.
