Введение: в статье исследуются проблемы правового регулирования квалификационных требований при проведении конкурса на замещение отдельных руководящих должностей кафедры образовательной организации МВД России. Актуальность темы обусловлена двойственной правовой природой указанных должностей, сочетающих статус аттестованного сотрудника органов внутренних дел и педагогического работника, а также несогласованностью норм служебного законодательства, законодательства об образовании, квалификационных справочников и профессиональных стандартов. Выявленная коллизия снижает уровень правовой определенности конкурсных процедур, создает риски субъективного усмотрения и оспаривания кадровых решений. Материалы и методы: материалами для исследования послужили труды отечественных правоведов, нормативно-правовые акты Российской Федерации, разъяснения уполномоченных органов по проведению конкурса и применения квалификационных требований к педагогическим работникам. Методологическую основу работы составили общенаучные (анализ, синтез, сравнение) и частнонаучные (формально-юридический, системный, логический, сравнительно-правовой) методы, приемы толкования и интерпретации правовых норм. Результаты исследования: выявлена несогласованность между Номенклатурой должностей педагогических работников организаций, осуществляющих образовательную деятельность, должностей руководителей образовательных организаций, утвержденной постановлением Правительства Российской Федерации от 21 февраля 2022 г. № 2251, Единым квалификационном справочником должностей руководителей, специалистов и служащих, утвержденным приказом Минсоцразвития РФ от 11 января 2011 г. № 1н2 (далее – ЕКС) и ведомственным конкурсным механизмом. Установлено отсутствие прямой регламентации квалификационных требований к должностям начальника кафедры и заместителя начальника кафедры в ведомственных актах МВД России, а также недостаточная правовая определенность механизма соотношения конкурсной процедуры и служебной аттестации. В связи с этим существующая модель конкурсного отбора фактически опирается на опосредованное толкование квалификационных требований, что снижает юридическую устойчивость кадровых решений. Обсуждение и заключение: обоснована необходимость ведомственной конкретизации квалификационных требований к должностям начальника кафедры и заместителя начальника кафедры образовательных организаций МВД России, предложено расширить основания проведения внеочередной аттестации для возможности участия в конкурсе на замещение должностей педагогических работников с принятием аттестационной комиссией соответствующих рекомендаций.
Introduction: the article examines the problems of legal regulation of qualification requirements in conducting a competition for the replacement of certain senior positions in the department of an educational institution of the Ministry of Internal Affairs of the Russian Federation. The relevance of the topic is due to the dual legal nature of these positions, which combine the status of an accredited employee of the Ministry of Internal Affairs and a teacher, as well as the inconsistency of the norms of service legislation, education legislation, qualification manuals, and professional standards. The identified conflict reduces the level of legal certainty in the competitive procedures and creates risks of subjective discretion and challenges to personnel decisions. Materials and Methods: the study was based on the works of Russian legal scholars, legal acts of the Russian Federation, and explanations provided by authorized bodies regarding the competition and the application of qualification requirements for teachers. The research was conducted using general scientific methods (analysis, synthesis, and comparison) and specific scientific methods (formal legal, systemic, logical, and comparative legal methods), as well as techniques for interpreting and applying legal norms. Results: inconsistency has been revealed between the Nomenclature of positions of teaching staff of organizations engaged in educational activities, positions of heads of educational organizations, approved by Decree of the Government of the Russian Federation dated February 21, 2022 № 225, the Unified Qualification Directory of positions of managers, specialists and employees, approved by Order of the Ministry of Social Development of the Russian Federation dated January 11, 2011 № 1n and departmental competitive the mechanism. It has been established that there is no direct regulation of the qualification requirements for the positions of head of department and deputy head of department in the departmental acts of the Ministry of Internal Affairs of the Russian Federation, as well as insufficient legal certainty in the mechanism of the correlation between the competitive procedure and the official certification. In this regard, the existing model of competitive selection actually relies on an indirect interpretation of the qualification requirements, which reduces the legal stability of personnel decisions. Discussion and Conclusions: the need for departmental specification of the qualification requirements for the positions of head of department and deputy head of department in educational organizations of the Ministry of Internal Affairs of Russia is substantiated, and it is proposed to expand the grounds for conducting extraordinary certification in order to participate in the competition for the positions of teaching staff, with the relevant recommendations being made by the certification commission.
